01The short version

These terms cover two separate things TechNourishment does:

• Building your website. Once you have paid the agreed project fees in full, the bespoke website we made for you is yours.
• Hosting it (optional). If you choose our hosting, we run your website on our hosting system for as long as the hosting service continues. Hosting your website does not make it ours, and ending hosting does not take it away from you.

Maintenance and domain names are also separate from both of these. The rest of this page explains each part in more detail. If anything in a written quote you have agreed with us differs from these terms, the quote takes priority for that project.

02About us and these terms

“TechNourishment”, “we” and “us” mean the business trading as TechNourishment. “You” means the customer buying our services. You can contact us at admin@technourishment.com.

These terms apply to every project and service we provide, together with the written quote or order confirmation for that work.

03Our services are separate

We offer the following services, which can be bought independently:

• Website design and development — a one-off project (Starter £299, Business £499, Advanced from £799, or a custom quote). Extra work outside the agreed scope is charged at £50 per hour and agreed with you first.
• Hosting — £29 per month, optional.
• Website Care (£49 per month) and Management (£89 per month) — optional ongoing plans that include hosting plus maintenance and a set amount of change time.

You can buy a website from us without buying hosting or maintenance, and host it wherever you like. Maintenance is only included where your chosen plan or quote says so.

04Website projects

Scope

Before work starts we confirm in writing the package, pages, features, number of revision rounds and total price. Changes to that scope are quoted before we do them.

Your part

We rely on you for content, feedback, approvals and access (for example to a domain or existing website). Delays in providing these may move the timeline.

Sign-off

We will ask you to review the website before launch. Once you approve it, or the site is launched at your request, the project is treated as delivered.

05Fees and payment

Prices are as shown on our website or in your written quote.

Your statutory rights as a consumer, where they apply, are not affected by anything in these terms.

06Who owns your website

In plain terms: once you have paid for your website in full, the bespoke parts we made for you are yours. Until then, they remain ours, and you do not own unpaid work.

What transfers to you

When the agreed project fees have been paid in full, we assign to you our rights in the deliverables created specifically for your website, to the extent we hold those rights. Depending on the project, this can include:

• the completed website as delivered;
• bespoke designs and client-specific layouts;
• graphics created specifically for you;
• website content we wrote for you as part of the project;
• code written specifically for your website;
• any other deliverables created specifically for your website.

What stays ours

To keep running our business, we keep ownership of materials that existed before your project or that we use across many projects, such as pre-existing and reusable code, code libraries, templates, reusable components, frameworks, development and internal tools, generic techniques and know-how, and our hosting systems and infrastructure.

Where any of these form part of your website, we give you a permanent, non-exclusive licence to use them as part of that website, including after hosting with us ends. This licence does not let you resell or reuse those materials separately.

Third-party and open-source materials

Some parts of a website are owned by others — for example open-source software, third-party plugins, licensed fonts, stock images, APIs and external services. We cannot transfer ownership of these. They remain subject to their own licences or terms, which you will need to follow. Where a licence is paid or tied to an account, we will tell you.

Before full payment

Until payment is complete, you may review work for the project, but we are not obliged to launch, transfer or hand over the website or its files.

07Materials you supply

Anything you give us — such as logos, brand assets, photographs, text, product information, videos, domain names or other existing intellectual property — remains yours. We do not take ownership of it.

You grant us permission to use those materials only to carry out the work you have asked for. You confirm you own them or have permission to use them on your website, and you are responsible if they infringe someone else’s rights.

08Hosting (optional)

If you choose our hosting, your website runs on TechNourishment’s hosting system for the duration of the service. Hosting your website does not give us ownership of it.

What is included

The hosting plan includes hosting of your website, an SSL certificate and security measures, regular backups, uptime monitoring and technical support, as described on our Hosting page. Website Care and Management add the extras listed for those plans.

What is not included

Unless your plan says otherwise, hosting does not include new features, redesigns, content changes, email hosting, domain registration or third-party subscriptions.

Fees, billing and renewal

Hosting is billed monthly at the plan price. Billing date and method: [To be confirmed: billing arrangements]. The service renews each month until cancelled.

Availability and maintenance

We take reasonable care to keep your website available, but we do not guarantee uninterrupted service or a particular uptime. Monitoring helps us notice problems; it is not a promise that they cannot happen. We may carry out planned maintenance and will try to do so at quiet times.

Security and backups

We apply reasonable security measures and take regular backups on hosting plans. No system is completely secure, and we cannot guarantee that every incident can be prevented or that every backup can be restored. Backup frequency and retention: [To be confirmed: backup schedule]. Support and performance

Technical support is provided for issues with the hosting service by email at admin@technourishment.com. Support is not unlimited, and response times are [To be confirmed: support response times, if any]. Storage and traffic are subject to fair use: [To be confirmed: any resource limits].

Acceptable use

You must not use the hosting for anything unlawful, harmful, abusive or that puts our systems or other customers at risk (for example malware, spam or infringing content).

Suspension

We may suspend hosting if fees are unpaid after we have told you, or immediately if the website is being used unlawfully or abusively or poses a security risk. We will restore the service once the issue is resolved where it is reasonable to do so.

Your responsibilities

You are responsible for the content on your website, for any data you collect through it, and for keeping any login details we give you secure.

09If you stop hosting with us

Ending hosting does not end your ownership of your website. If your website project has been paid for in full, you keep your rights in it.

• You can end hosting by emailing admin@technourishment.com. Notice period: [To be confirmed: notice period].
• Where technically possible, we will provide your website files and content so you can move to another provider. Format and method: [To be confirmed: export format]. Any charge for migration help: [To be confirmed: migration fee, if any].
• We may ask for any outstanding hosting fees to be paid before handing over files. Project fees must be paid in full for ownership to have transferred.
• Some parts tied to our hosting system or to third-party accounts may not be transferable; we will tell you what can and cannot move.
• After hosting ends, we will delete hosted files and data within [To be confirmed: deletion period].

10Domain names

Your domain name is separate from your website. Buying a website from us does not mean we own your domain, and it does not mean we register it for you.

• If you register the domain yourself, you remain responsible for its registration and renewal. We may ask for access to point it at your website.
• If we agree in writing to register or manage a domain for you, the arrangement, who the registrant is and renewal charges will be set out at that time: [To be confirmed: domain management arrangement].

11Maintenance and changes

Maintenance is separate from ownership and from basic hosting. It is only provided where your plan (Website Care or Management) or quote includes it. Website Care includes up to 30 minutes of changes a month and Management includes 1 hour; unused time does not roll over. Other changes are charged at £50 per hour, agreed in advance. We do not commit to specific response times unless agreed in writing.

12Showing your website in our portfolio

Once your website is live, we may show it — its name, screenshots, a link and a short description of our role — as an example of our work on our website and in our marketing.

We will not do this if you tell us you do not want it, if you have a confidentiality agreement with us, or for anything you have told us is confidential. You can ask us to remove it at any time by emailing admin@technourishment.com.

13Liability

We will carry out our services with reasonable care and skill. Nothing in these terms limits liability that cannot legally be limited, such as for death or personal injury caused by negligence, or for fraud.
